Catholic Hospital in Germany Upholds Abortion Ban, Sparks Controversy

In a recent ruling, a German court upheld a Catholic hospital's right to ban abortions, even in cases of severe fetal malformations. The decision has sparked controversy and protests, with the chief physician of the Lippstadt Clinic, Dr. Joachim Volz, vowing to continue legal challenges.

German law allows for abortion within the first 12 weeks after mandatory counseling, with exceptions for medical necessity, fetal malformation, or cases of rape. However, the hospital operator's internal rules may impose stricter restrictions, as seen in this case.

The Hamm Labour Court sided with the Catholic operator of Klinikum Lippstadt-Christian Hospital, following a merger that placed the hospital under Catholic management. The ban permits abortion only when the life or limb of the pregnant woman is in immediate danger, excluding other medical indications like severe fetal malformations.

Dr. Volz, who lost his lawsuit against the ban, believes that it ignores the medical judgment, the will of the patient, and the law that permits such interventions in certain cases. He has stated that he will "almost certainly" appeal the court's decision to the next judicial instance.

The issue has resonated with the public, with approximately 2,000 people participating in a demonstration titled "Stop the Catholic Abortion Ban" outside the Lippstadt Clinic. Sarah Gonschorek (Greens) organized the demonstration, expressing concern over the ban as a great injustice to affected women.

Politicians from the federal and state governments of North Rhine-Westphalia, including the co-faction leader of the Greens, Britta Haßelmann, attended the demonstration. Placards at the demonstration read "Heaven Hell Hypocrisy! Church, let the women go free" and "Help and self-determination instead of punishment".

The managing director of the clinic, Hauke Schild, argues that an employer has the right to determine what is done and what is not done in its company, citing entrepreneurial freedom. The legal representative of the plaintiff, Till Müller-Heidelberg, counters that a clinic management cannot issue service instructions that include the medical area - i.e., diagnostics and therapy.

The court's decision was based on the employer's right to make specifications within its right of directive. Medically indicated abortions are not categorically prohibited in the clinic, but are permitted in parts, specifically in cases where the life of the mother or the unborn child is acutely threatened and there is no medically possible alternative to save the life of the unborn child.

Despite the controversy, Dr. Volz remains committed to his role as a physician. He has stated that a resignation is not an option for him, as his help as a doctor is a "dictate of humanity". A new exhibition titled "Second opinion" is currently on display in Hamm, reflecting the ongoing debate and public interest in this issue.
