In a recent ruling, the Hamm Labor Court upheld the abortion ban at the Lippstadt Clinic, a Catholic-operated hospital, following a legal challenge by the clinic's chief physician, Joachim Volz. The ban, which restricts abortions to cases where the mother's life is in acute danger, has been met with significant opposition from Volz and supporters who argue that it contravenes medical conscience, women's rights to healthcare, and legal medical options.

The controversy stems from the merger of the Lippstadt Clinic into a Catholic hospital group, which has given the church control over a previously Protestant-run facility that had no abortion restrictions. The Catholic hospital's directive permits abortion only in cases of acute maternal life-threatening situations, excluding many cases of severe fetal anomaly or non-imminent maternal risk that are considered medically indicated outside church-operated institutions.

Volz, who had been performing medically necessary abortions such as in cases of severe fetal malformations or threats to the mother's health, lost the legal fight but announced plans to appeal. He started a petition titled "I am a doctor - my help is not a sin!" on July 1, which has been signed by over 232,000 people.

The ruling highlights the tension between religious institutional rights to enforce doctrine in healthcare and physicians’ responsibilities to provide medically necessary treatments. The case is emblematic of ongoing disputes in Germany over the extent of the Catholic Church’s special rights in hospital settings.

The public response to the court case has been significant, with over 2,000 people attending a demonstration organized by Volz in August. Politicians from federal and state levels of North Rhine-Westphalia, including Britta Haßelmann, the co-fraction leader of the Greens, were present at the demonstration. The demonstrators' placards read slogans such as "Heaven Hell Hypocrisy! Church, let the women go free" and "Help and self-determination instead of punishment".

The court noted that medically indicated abortions are not categorically prohibited in the clinic, but are permitted in certain cases, such as when the life or health of the mother or unborn child is acutely threatened and there is no medically possible alternative to save the life of the unborn child. However, the court also stated that the employer is entitled to its measures, citing entrepreneurial freedom.

The ongoing legal appeals and public debate point to an uncertain future where further judicial or legislative developments could change how medically indicated abortions are handled in Catholic-operated hospitals like Lippstadt.
