India’s 2025 Data Protection Rules Set New Standards for Privacy and Industry Growth

The Ministry of Electronics and Information Technology has released the Digital Personal Data Protection Rules 2025, a significant step in India's data protection journey. The rules were formulated using a consultative approach, involving various stakeholders.

Key aspects of the final rules include enhanced clarity on verifiable consent and dedicated provisions for protecting children and individuals with disabilities. The rules also provide a clearer roadmap for industry, addressing operational challenges and promoting responsible data protection.

The consultation process led to improvements in readability and consistency, particularly in sections related to processing by the State. However, certain matters raised during consultation, such as the structure of parental consent and breach notification requirements, could not be addressed through subordinate legislation.

Nasscom-DSCI, a leading industry body, recognises the importance of developing mechanisms for international data transfers. This is crucial for interoperability and cooperation with India's trading partners, supporting growth in sectors like IT-ITES, global capability centres, platform businesses, start-ups, and technology SMEs.

The Digital Personal Data Protection Rules 2025, notified recently, offer a stable and predictable transfer environment, vital for operationalising personal data protection and boosting India's digital economy.
