Germany's gender self-declaration law has sparked controversy, with provocateurs exploiting it to access women's spaces. Meanwhile, Austria has taken a more cautious approach, focusing on practical solutions for trans persons while avoiding cultural conflicts.

In Germany, individuals like Sven Liebich and Walter P. have posed as women to demand entry into women's spaces and services, taking advantage of the law that allows anyone to freely choose their gender entry with a self-declaration. This has raised concerns about the safety of women's hard-won achievements.

In Austria, the process is more regulated. A change in gender entry at the registry office is made easy for those who don't match their birth gender, but psychiatric reports are required. Organizations like pro mente OÖ have developed concrete proposals for practical everyday solutions, aiming to avoid cultural conflicts over women's rights. These include seminars and educational programs that focus on collaborative, experience-based approaches and creative methods to create actionable guidelines for daily care and social interactions.

Transgender people may be particularly vulnerable to anti-feminist backlash. Sibylle Hamann, a former National Council member and education spokesperson for the Greens, now teaches at a Vienna middle school and advocates for understanding and support.

While Germany's law has led to provocative exploitation, Austria's more cautious approach, focusing on practical solutions and coexistence rules, has so far avoided potential cultural battles. Both countries, however, must remain vigilant to protect the rights and safety of all individuals.
